By accessing the Union Creative website, client portal, booking system, or purchasing our services, you agree to the terms outlined below. These terms apply to services provided by Union Creative, including video production, photography, real estate media, social media content, advertising creative and management, strategy, consulting, and related creative services.

Services & Scope

The services, deliverables, timelines, pricing, and responsibilities for each project are determined by the applicable booking, quote, proposal, contract, or invoice.

Requests outside the agreed scope may be subject to additional fees and may affect the original timeline.

Bookings & Scheduling

Bookings are subject to availability and are confirmed once accepted by Union Creative.

Clients are responsible for providing accurate project details, locations, access instructions, contacts, and any information reasonably required to complete the work.

Union Creative reserves the right to reschedule production due to weather, safety concerns, illness, equipment issues, property access, travel conditions, or other circumstances outside our reasonable control.

Cancellations & Rescheduling

Clients should provide reasonable notice when cancelling or rescheduling a project.

Late cancellations, same-day changes, no-shows, or situations where our team arrives but is unable to complete the scheduled work may be subject to cancellation, travel, or production fees.

Deposits and payments may be non-refundable where production time, contractors, travel, rentals, locations, talent, or other resources have already been committed.

Client Responsibilities

Clients are responsible for ensuring that locations, properties, products, staff, talent, and other required elements are prepared and available at the agreed production time.

Union Creative is not responsible for delays caused by incomplete preparation, unavailable individuals, restricted access, missing products, property conditions, or client-requested changes.

Unless otherwise agreed, clients are responsible for obtaining any permissions, releases, permits, or approvals required for locations, people, trademarks, products, or other materials they request to be included in the project.

Payments

Payment terms are outlined on the applicable booking, quote, proposal, contract, or invoice.

Invoices must be paid according to the stated payment terms. Union Creative may pause production, editing, advertising, delivery, or access to completed work while an account has an outstanding balance.

Approved expenses including travel, accommodation, rentals, models, locations, props, licensing, and subcontractors may be charged separately.

Copyright & Ownership

Unless otherwise agreed in writing, Union Creative retains copyright and ownership of photography, video footage, edited content, graphics, designs, and other creative materials produced by our team.

Once the applicable invoice has been paid in full, clients receive the usage rights agreed upon for that project.

Delivery of finished content does not automatically transfer ownership of raw footage, project files, editable files, unused images, or other source materials.

Content may not be resold, sublicensed, transferred, or supplied to unrelated third parties for commercial use outside the original project without written permission from Union Creative.

Raw Footage & Project Files

Raw footage, unedited photography, project files, design files, timelines, and other source materials are not included with final delivery unless specifically stated.

Where available, these files may be purchased or supplied under a separate agreement.

Union Creative does not guarantee permanent storage of project files after final delivery. Clients are responsible for downloading and safely storing their completed content.

Portfolio & Promotional Use

Unless otherwise agreed in writing, Union Creative may display completed work as part of our portfolio and marketing.

This may include our website, social media, advertisements, presentations, demo reels, case studies, proposals, award submissions, and other promotional materials.

Confidential, embargoed, or unreleased projects will be handled according to any written confidentiality agreement established before publication.

Revisions

Included revisions are determined by the package, booking, proposal, or agreement associated with the project.

Major changes in creative direction, additional versions, new concepts, re-editing after approval, or requests outside the original scope may result in additional charges.

Clients are responsible for reviewing all content carefully before giving final approval.

Turnaround Times

Any turnaround time provided by Union Creative is an estimate unless specifically guaranteed in writing.

Delivery may be affected by project complexity, client feedback, weather, travel, approvals, third-party suppliers, technical problems, or other circumstances outside our reasonable control.

Advertising & Marketing Services

Union Creative does not guarantee specific sales, leads, revenue, return on advertising spend, follower growth, website traffic, or other business results.

Marketing performance can be affected by factors outside our control, including pricing, offers, competition, market conditions, websites, sales processes, advertising budgets, platform algorithms, and customer behaviour.

Unless otherwise agreed, advertising spend is paid separately by the client directly to advertising platforms.

Third-Party Platforms

Union Creative may use third-party platforms to provide our services, including scheduling systems, payment processors, advertising platforms, social networks, analytics providers, file hosting platforms, cloud storage, email services, website providers, and project management software.

We are not responsible for outages, account restrictions, algorithm changes, policy changes, platform errors, data loss, or other issues caused by third-party providers outside our reasonable control.

Music, Stock Assets & Third-Party Licensing

Projects may contain licensed music, stock footage, photography, fonts, templates, graphics, or other third-party materials.

These materials remain subject to the licensing terms established by their respective rights holders.

Clients may not extract, redistribute, sell, or reuse licensed assets separately from the completed project unless the applicable licence specifically permits it.

Real Estate Media

Properties should be clean, staged, accessible, and ready to photograph before the scheduled appointment.

Union Creative is not responsible for cleaning, staging, landscaping, moving furniture, concealing personal belongings, or making substantial changes to a property.

Photography, video, and drone services may be affected by weather, property conditions, access, lighting, airspace restrictions, and safety considerations.

Drone operations are subject to applicable laws, regulations, airspace restrictions, weather conditions, and the judgement of the drone operator.
